Terms of Service
1. Who we are
Trouvo is operated by ivmar, Inc., a company incorporated in the State of Delaware, United States. These terms are the agreement between you and ivmar, Inc. for your use of Trouvo (the website, the application and everything we serve from them). By creating an account or using Trouvo you accept these terms. If you do not accept them, do not use the service.
2. Eligibility
You must be at least 16 years old to use Trouvo. If the law where you live sets a higher age for consenting to online services on your own, you must have reached that age. By using Trouvo you confirm that you meet this requirement and that you are able to enter into a binding agreement.
If you use Trouvo on behalf of an employer or another organisation, you confirm that you are authorised to accept these terms for it, and "you" in this document then means that organisation as well.
3. Your account
You need an account to use most of Trouvo. You can create one with an email address and a password, or by signing in with a Google, Apple or LinkedIn account.
You are responsible for the accuracy of the details you give us, for keeping your password confidential, and for everything that happens under your account. Tell us at support@ivmar.co as soon as you believe someone else has access to it.
One person, one account. Do not share your account, sell it, or let someone else use it.
4. Acceptable use
Use Trouvo for preparing your own job applications and interviews. Do not:
- break the law, or use Trouvo to help anyone else do so;
- upload content that infringes someone else's rights, or personal data about other people that you have no right to share;
- misrepresent who you are, or impersonate another person or organisation;
- attempt to gain access to accounts, data or systems that are not yours;
- probe, scan, overload or disrupt the service, or circumvent any limit, authentication or rate limit we apply;
- scrape, crawl or bulk-download the service, or resell access to it;
- upload malware, or anything designed to interfere with the service or with other users.
We may suspend or close an account that breaks these rules.
5. Your content
Everything you put into Trouvo (anything you write, upload or otherwise provide as the product comes to accept it) stays yours. We claim no ownership of it.
You grant ivmar, Inc. a licence to host, store, copy, transmit, display and process that content, and to create the derived material the product produces from it, strictly to the extent needed to operate Trouvo for you, to keep it secure, and to comply with the law. The licence ends when the content or the account is deleted, except for copies held in backups until they expire on their normal schedule.
You are responsible for the content you provide: for having the right to provide it, and for its accuracy.
6. Our intellectual property
Trouvo itself (the software, the design, the text, the logos and the name) belongs to ivmar, Inc. or to the parties that licensed it to us. These terms give you a personal, non-exclusive, non-transferable and revocable right to use the service. They give you no other right in it. Do not copy, modify, decompile, reverse-engineer or create derivative works from any part of Trouvo except where the law says you may despite this restriction.
7. Subscriptions and payment
Parts of Trouvo may be offered on a paid subscription. Where they are, the plans, their contents, the billing periods available and the price of each are shown in the product before you subscribe, and that is what you agree to when you subscribe. Prices are stated in the product inclusive or exclusive of taxes as shown there; any tax that applies to you is added at checkout.
A subscription starts when your first payment is taken, runs for the billing period you chose, and renews automatically for a further period of the same length at the end of each one, at the price then shown for that plan, until you cancel. We charge the payment method on your account for each renewal.
We will tell you in advance, by email, before a price change or a change of billing period takes effect for your subscription, so that you can cancel before it applies.
If a payment fails we may retry it and may suspend access to paid features until it succeeds.
8. Cancellation
You can cancel a subscription at any time in the product. Cancellation stops the next renewal: you keep access to the paid features until the end of the period you have already paid for, and no further payment is taken after that.
You can have your account deleted at any time by writing to support@ivmar.co. Trouvo has no settings or profile page yet, so deletion goes through that address rather than a button in the product. Deleting the account ends the agreement and stops future renewals, and is not by itself a request for a refund of the current period.
9. Refunds
Payments for a period that has begun are not refunded, except where these terms say otherwise, where the law where you live gives you a right to a refund, or where the service failed materially and we could not put it right within a reasonable time. Nothing here limits a statutory right you have as a consumer.
If you believe a payment was taken in error, write to support@ivmar.co and we will look into it.
10. Right of withdrawal (EU/EEA consumers)
If you are a consumer resident in the European Union or the European Economic Area, you have the right to withdraw from a contract for digital services within 14 days of entering into it, without giving a reason. To exercise it, write to support@ivmar.co within that period; a clear statement is enough.
Trouvo is available to you as soon as you subscribe. By subscribing and asking us to start providing the service immediately, you expressly consent to performance beginning before the 14-day period ends, and you acknowledge that you lose the right of withdrawal once we have fully performed. Where we have only partly performed when you withdraw, you pay a proportion of the price matching what you have used, and we refund the rest.
11. Service availability and changes
We work to keep Trouvo available, but we do not promise that it will be uninterrupted or error-free. We may take it down for maintenance, and we may change, add or remove features as the product develops.
Where a change materially reduces what a paid plan gives you, we will tell you before it takes effect and you may cancel your subscription.
12. Disclaimers
Trouvo helps you prepare. It does not find you a job, it does not guarantee an interview or an offer, and its output is not legal, financial, immigration or career advice. Check anything it produces before you rely on it or send it to anyone.
To the extent the law allows, Trouvo is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
13. Limitation of liability
To the extent the law allows, ivmar, Inc. is not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost opportunities, lost employment or lost data arising out of your use of Trouvo.
Where ivmar, Inc. is liable, its total liability for all claims arising in any 12-month period is limited to the greater of the amount you paid for Trouvo in that period and 50 EUR.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, and any statutory liability owed to you as a consumer.
14. Termination
You may stop using Trouvo at any time, and you may ask us at support@ivmar.co to delete your account. There is no self-service deletion in the product yet; section 8 says how the request works.
We may suspend or terminate your access if you break these terms, if we are required to by law, or if we discontinue the service. Except where the breach is serious or the law requires immediate action, we will give you notice and a chance to put things right. If we discontinue the service or terminate your access without cause while you have a paid subscription, we refund the unused part of the period you paid for.
Sections that by their nature should survive termination (your content licence for backups, our intellectual property, disclaimers, limitation of liability and governing law) survive it.
15. Changes to these terms
We may change these terms as the product and the law change. The current version is always at this address, with the date it took effect at the top.
Where a change materially affects your rights or obligations, we will tell you by email or in the product at least 30 days before it takes effect. Continuing to use Trouvo after that date means you accept the new terms. If you do not accept them, cancel your subscription and stop using the service before they take effect.
16. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules, and the courts of that State have jurisdiction over disputes arising from them.
If you are a consumer, this does not deprive you of the protection of the mandatory rules of the law of the country where you live, and you may also bring proceedings in the courts of that country.
